Beys Liston & Mobargha Wins Summary Judgment in Long-Running Intra-Family Dispute
On March 8, 2018, Beys Liston & Mobargha won summary judgment in the Commercial Division of the Supreme Court, New York County on behalf of its clients on all claims against them stemming from allegations that the clients misappropriated millions of dollars held by an offshore trust. Before the firm’s entry as counsel, the case had been litigated for a decade with no resolution in sight. Beys Liston & Mobargha entered the case, aggressively litigated the matter, and brought a motion for summary judgment. Adopting Beys Liston & Mobargha’s arguments that the plaintiff had failed to establish conversion, unjust enrichment, or an entitlement to a constructive trust, the court dismissed the claims against the clients in their entirety.
